Invitation to tender for justices of the peace
for the arbitration district V
The City of Chemnitz is looking for citizens who would like to take on the honorary office of a justice of the peace for the arbitration centre district V.
In accordance with the law on arbitration boards in the municipalities of the Free State of Saxony and on the recognition of arbitration boards within the meaning of Section 794 (1) No. 1 of the Code of Civil Procedure (SächsSchiedsGütStG) of 27 May 1999, the City of Chemnitz is obliged to set up arbitration boards.
The duties of an arbitration centre are carried out by an honorary justice of the peace.
The district of an arbitration centre does not comprise more than 50,000 inhabitants.
The justice of the peace must be suitable for the office in terms of his/her personality and skills.
A justice of the peace may not be a person who is admitted to the bar or appointed as a notary public, or who exercises the management of other people's legal affairs on a professional basis, or who holds the office of a professional judge or public prosecutor or works as a police or judicial officer.
Furthermore, a justice of the peace may not be a person who is not qualified to hold public office or who is restricted by court order in the disposal of his/her assets, who has not yet reached the age of 30 or has already reached the age of 70 at the beginning of the term of office, who does not live in the arbitration district, who has violated the principles of humanity or the rule of law or who has worked for the former Ministry for State Security or the Office for National Security.
The justice of the peace must declare in writing that the above grounds for disqualification do not apply and give his/her consent to obtaining information on the grounds for disqualification from the Federal Commissioner for the Records of the State Security Service.
The Justice of the Peace is elected for a period of 5 years by the City Council of the City of Chemnitz and requires confirmation by the Board of the Local Court of Chemnitz.
The purpose of the proceedings before the arbitration boards is to settle legal disputes by reaching an agreement between the parties.
The arbitration board conducts arbitration proceedings in civil disputes concerning property claims and non-property claims due to injury to personal honour.
The arbitration procedure does not take place in legal disputes that fall under the jurisdiction of the family and labour courts, which concern the violation of personal honour in the press, radio and television and in which the federal government, the federal states, the municipalities or other corporations, institutions or foundations under public law are involved.
Pursuant to Section 12 of the SächsSchiedsGütStG, the justices of the peace are subject to the professional supervision of the board of the local court; they are independent in the conduct of the arbitration board's hearings (Section 12 (2) sentence 3 SächsSchiedsGütStG).
Outside of these proceedings, the justices of the peace are subject to the supervision and instructions of the City of Chemnitz.
The Bund Deutscher Schiedssmänner und Schiedsfrauen e.V. offers training and further education courses.
A monthly allowance of 25 euros is paid to cover expenses such as paper, telephone charges, etc.
The new arbitration district to be filled comprises the following areas:

Ebersdorf, Euba, Yorckgebiet, Hilbersdorf, Sonnenberg
