Announcement by the City of Chemnitz on the redemption of a section of road in accordance with Section 8 of the Road Act for the Free State of Saxony (SächsStrG)

1. road description
Section of the local road "Eckstraße" (inventory sheet no. 235) on parcel T.v. 242/2 and parcel 24/2, district of Schloßchemnitz as a road stub with its location from the river Chemnitz to the public "Hauboldstraße"
2. disposal
The road section described in more detail under 1. is to be withdrawn over a length of 35 m in accordance with Section 8 of the Road Act for the Free State of Saxony (SächsStrG) of 21 January 1993, last amended by Art. 1 of the Act of 20 August 2019 (SächsGVBl. p. 762).
In accordance with Section 8 (5) SächsStrG, public use (Section 14 SächsStrG) and special use (Section 18 SächsStrG) cease with the confiscation.
The confiscation procedure is carried out on the basis of a structural remodelling with the purpose of management as a park. The administrative act is issued on the basis of the resolution passed by the Committee for Urban Development and Mobility on 30 April 2025 with resolution no. B-092/2025.
The redemption becomes effective at the time of the public announcement.
3. inspection
The order can be inspected by prior appointment by telephone on 488-7741 at the Chemnitz City Administration, Technical City Hall, Friedensplatz 1 (Traffic and Civil Engineering Office). In addition, the site plan with publication can be viewed on the website of the City of Chemnitz at www.chemnitz.de/bekanntmachungen.
4 Your rights/information on legal remedies
An objection to this general ruling may be lodged within one month of its announcement. The objection must be submitted in writing, in electronic form in accordance with Section 3a (2) of the Administrative Procedure Act, in written form in accordance with Section 3a (3) of the Administrative Procedure Act and Section 9a (5) of the Online Access Act or for recording at the City of Chemnitz, Markt 1, 09111 Chemnitz or at any other office or citizen service centre of the City of Chemnitz.
If the objection is lodged in writing in accordance with Section 3a (3) of the Administrative Procedure Act, the following options are available:
1. using the online application "Submit an objection" available on the website of Office 24(www.amt24.sachsen.de) and identification via eID
2. in the case of legal representation, by filing via the special public authority mailbox (beBPo) "Stadt Chemnitz".
The general ruling is published in accordance with Section 41 (3) and (4) VwVfG and is deemed to have been published on the following day.
