We would like to point out that the online application requires the provision of personal information (by you), its storage and processing by the City of Chemnitz. There is no legal or contractual obligation to provide data.

2 Purpose and legal basis of data processing

We process the personal data you provide to us via the online applicant portal exclusively for the purpose of processing your application for the advertised position. The minimum data required for this are marked as mandatory data, without which you cannot send the application. We process this data on the basis of Section 11(1) of the Saxon Data Protection Implementation Act. The Free State of Saxony has thus made use of the regulatory authorisation of Art. 88 GDPR for the public sector.

Article 6(1)(a) GDPR is the legal basis for data processing for data that you provide to us voluntarily. This also applies to the indication of a severe disability or equalisation, which is at your discretion.

No automated decision-making or profiling takes place in the application process.


3 Recipients

The data you enter in the online application portal will be stored exclusively on the City of Chemnitz servers.

All information will be treated in strict confidence and will only be made available within the City of Chemnitz to those departments that are absolutely involved in processing the application. Within the City of Chemnitz, therefore, only those persons and departments will receive your
personal data that need it to process the recruitment procedure or to fulfil our legal obligations.

In accordance with Sections 81 (1) sentence 1, 95 (2) sentence 1 SGB IX, the representative body for severely disabled persons must be informed immediately and comprehensively about applications from severely disabled persons as soon as the application is received. If you as an applicant indicate a severe disability with a degree of at least 50 or with equal status in the application portal, your application can be viewed by the responsible representative body for severely disabled persons.


4 Duration of storage

Your data will be deleted six months after completion of the application process.
The application process is deemed to have been completed when the employment contract has been concluded with the selected applicant.

If an employment relationship is established, data from the application process will be transferred to the personnel management system or the electronic personnel file. Otherwise, data will only be stored for longer if statutory provisions prevent deletion, if further storage is necessary for the assertion, exercise or defence of legal claims or if you have expressly consented to longer storage.


5 Use of cookies

To ensure that your entries and the documents you have added remain available until you submit the application form when using the online application portal, the online application portal stores a so-called session cookie on your end device. This is a small text file that contains a unique number (session ID). This cookie is required for the portal to function and is deleted or loses its validity at the end of the session (when you close the browser).


6 Your rights vis-à-vis the controller (City of Chemnitz, see contact details)

To exercise your rights listed below, you can contact the office at the main office indicated in the contact details.

6.1 Information

You have the right to obtain confirmation from us as to whether or not personal data concerning you is being processed. If this is the case, you have the right of access to this personal data (including the right to receive a copy) and to further information in accordance with Article 15 GDPR.

6.2 Rectification

You have the right to rectification and/or completion if the personal data concerning you is incorrect or incomplete (Article 16 GDPR).

6.3 Erasure

You have the right to demand that we erase the personal data concerning you and we are obliged to erase your personal data immediately under the conditions of Article 17 GDPR.

6.4 Restriction of processing

You have the right to obtain from us restriction of processing where one of the conditions set out in Article 18(1) GDPR applies. Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

We will inform all recipients to whom your personal data has been disclosed of any rectification or erasure of personal data or restriction of processing in accordance with Article 16, Article 17(1) and Article 18 GDPR, unless this proves impossible or involves disproportionate effort. We will inform you about these recipients if you request this.

6.5 Revocation of consent

You have the right to withdraw your consent to the processing of personal data at any time (Article 13(2)(c) GDPR). The lawfulness of the previous data processing remains unaffected by this. If you wish to withdraw your consent, please send an email to the main office of the city administration (controller) at karriere@stadt-chemnitz.de, stating the reference number of the advertisement and your name.

If you make use of your rights, we will check whether the legal requirements are met.


7 Right to lodge a complaint with a supervisory authority

You also have the right to lodge a complaint with a data protection supervisory authority at any time if you are of the opinion that data processing has taken place in breach of applicable law.
