Public notice:
Announcement by the City of Chemnitz on the confiscation of a section of a car park in accordance with Section 8 of the Road Act for the Free State of Saxony (SächsStrG)

1. car park description
Section of the restricted public space with the dedication restriction: car park on the parcel T.v. 257/2 (will become new: T.v. 4223), Chemnitz district with its location on the streets "Getreidemarkt/Lohstraße", inventory sheet no. 1303.
2. disposal
The car park described in more detail under 1. is withdrawn in accordance with Section 8 of the Road Act for the Free State of Saxony (SächsStrG) of 21 January 1993, last amended by Art. 1 of the Act of 20.08.2019 (SächsGVBl. p. 762) over an area of 747 m².
In accordance with Section 8 (5) SächsStrG, public use (Section 14 SächsStrG) and special use (Section 18 SächsStrG) cease with the confiscation.
The redemption is based on the establishment of the reallocation plan for the reallocation procedure 72 - Theaterstraße/Lohstraße with the reallocation decision from the provisions of B-Plan No. 93/03 entitled "Getreidemarkt".
The redemption also takes place on the basis of the resolution passed by the Committee for Urban Development and Mobility on 30 April 2025 with resolution no. B-089/2025
The redemption will take effect at the time of the public announcement.
3. inspection
The order can be inspected by prior appointment by telephone on 488-7741 at Chemnitz City Council, Technical City Hall, Friedensplatz 1 (Traffic and Civil Engineering Office), Room A 249. In addition, the site plan with publication can be viewed on the website of the City of Chemnitz at www.chemnitz.de/bekanntmachungen.
4. information on legal remedies
An objection to this general ruling may be lodged within one month of its announcement. The objection must be submitted in writing, in electronic form or for recording at the City of Chemnitz, Markt 1, 09111 Chemnitz or any other office or citizen service centre of the City of Chemnitz.
The objection can be lodged in electronic form by De-Mail in the transmission variant with confirmed secure registration in accordance with the De-Mail Act. The De-Mail address is: info(at)stadt-chemnitz.de-mail.de
If represented by a lawyer, the objection can also be lodged via the special public authority mailbox (beBPo) and must be addressed to the beBPo "City of Chemnitz".
The general ruling will be published in accordance with Section 41 (3) and (4) VwVfG and is deemed to have been published on the following day.
