Invitation to submit a bid to take over a service concession

Spring market in the years 2026 - 2030

The City of Chemnitz is looking for interested organisers for the organisation and staging of a spring market in the years 2026 to 2030.
The service concession will be put out to tender for five years.


Selling times/opening hours:

Period: 2 calendar weeks in the months of March / April or May of each year

from 11 a.m. to a maximum of 9 p.m., but at least until 6 p.m., every calendar day

Venue: Neumarkt Chemnitz, outside the areas of the outdoor catering area (see appendix)


The following general conditions must be observed:


1. group of participants:

At least 10 participants, of which at least 6 without a culinary offer

  • Easter/spring-themed product ranges (ceramics, table decorations, decorative items, table linen)
  • Baked goods (possibly with a show oven or other handicrafts on display)
  • Easter confectionery, ice cream
  • Smoked goods
  • cheese
  • eggs
  • Flowers and plants, Easter branches
  • Wickerwork
  • Wool, felt and natural products
  • Unpackaged food, sale of glass jars
  • Paper and stationery, books
  • Clothing (spring/summer season, children's clothing)
  • Children's toys (made of wood or other sustainable raw materials)
  • Children's attractions (children's rides, face painting, children's crafts)
  • Snacks and drinks
    including
    • Langos
    • fish
    • International snack bar
    • Grill snack
    • Waffles/crêpes
    • Trolley with outdoor seating
    • Coffee bar/sales
    • Wine sales, wine tasting and serving
    • Vegetarian/vegan dishes
  • Assortments or offers that correspond in particular to the character of the spring market


2. design

  • Traditional Easter/spring decoration of the stalls and the area
  • Shelter for guests
  • Seating and standing areas with tables or storage facilities for drinks and food (covered and distributed over the area)
  • Other structures
    • Small stage or a raised performance area
    • Children's attraction/s


3. culture

  • Craft demonstrations (e.g. slate modelling, wood painting, figure making, etc.)
  • Music performances


4. other requirements

  • The selected applicant must submit an application to the City of Chemnitz for the event to be recognised as a special market in accordance with § 68 Para. 1
    Gewerbeordnung (subject to a fee).
  • A security concept must be drawn up for the market and implemented following approval by the City of Chemnitz.
  • Accessibility must be ensured as far as possible.
  • An annual licence fee of 3,000.00 euros must be paid to the City of Chemnitz. You are entitled to pay an additional voluntary
    concession fee of your choice.
  • The utilisation fee for the allocated areas is not included in the concession fee and must be applied for via an application for special use at the traffic and civil engineering office. Electricity connection and consumption fees must be paid by the customer.
  • Current proof of insurance required annually
  • Cleaning of the area (before and during the market) must be organised by the customer.
  • Public address system and GEMA fee are at your own expense.
  • Consideration must be given to outdoor catering, which may be possible/necessary under certain circumstances.
  • Sufficient waste bins must be provided to cope with the expected volume of waste.


The application must be accompanied by

  • Business registration
  • Current police clearance certificate of the legal representative of the licence holder
  • current extract from the central trade register
  • current tax clearance certificate
  • current proof of insurance
  • Event concept for the spring market with photos or assessable design proposal for the structures
  • references
  • Declaration by the applicant confirming that they are not prohibited from trading due to unreliability and that no corresponding proceedings are pending or a trade licence has been revoked or withdrawn
  • Declaration by the applicant to take over the cleaning and GEMA registration
  • Scaled sketch of the possible arrangement of the stands on the areas specified in this invitation to tender (for area plan see attachment)


5. cancellation


In the event of non-compliance with the concession requirements, the City of Chemnitz reserves the right to special cancellation and to withdraw from the award of the contract.


Realisation risk


The concessionaire alone bears the economic risk in the realisation of the event. The licence holder must take out adequate insurance against claims for damages by event participants or third parties and provide proof of this to the City of Chemnitz without being asked to do so.

The following factors are taken into account in the evaluation of the application and the subsequent selection:

  • Compliance with the design specifications according to the invitation to tender
  • Compliance with the group of participants according to the invitation to tender
  • Proposed arrangement of the stands and required structures by means of the attachment
  • Amount of the additional concession fee to be paid
  • Cultural offerings/programme
  • Completeness of the application documents


Incomplete applications must be completed/missing documents must be submitted by the end of the tender period. If this deadline is not met, the application cannot be considered.

If the requirements for exercising a trade in accordance with the Trade Regulation Act cease to apply after the application deadline, the relevant applicant and his/her application must be excluded from the procedure.

The procurement regulations according to VOL/VOB do not apply to this procedure.
