for private individuals (including foster parents) and independent youth welfare organisations

The Economic Youth Welfare (WJH) of the Youth Welfare Office is responsible for the assumption of costs, collection in the form of cost contributions and processing of cost reimbursements within the framework of SGB VIII

for outpatient, partial inpatient and inpatient forms within the

  • youth welfare services,
  • educational assistance,
  • integration assistance for mentally handicapped children and young people,
  • Assistance for young adults and
  • provisional measures for the protection of children and young people

Notes

Services are provided exclusively by the General Social Service and the Special Services Department (foster children service or youth court assistance) of the Youth Welfare Office.

In the WJH, the costs for the services, assistance and measures, including ancillary services/subsidies, are covered within the scope of this provision in accordance with SGB VIII. During the provision of partial inpatient and inpatient services, the parties involved are required to bear the costs to the extent regulated by law (§§ 91 ff SGB VIII). For inpatient services, the child benefit is to be paid from income in accordance with § 94 Para. 3 SGB VIII, irrespective of whether or not the child benefit is utilised.

Proof of income is requested when the notification of the cost contribution obligation is sent. Proof in the form of wage/salary calculations, social assistance notices, pension notices, sickness benefit payments, etc. are required for the entire previous year (January-December) of assistance. For example, income documents for the whole of 2014 must be submitted if benefits are to be granted in 2015. Data on the receipt of child benefit is also required. Who is entitled to child benefit and what amount is the child/young person/young adult entitled to? The obligation to provide evidence also includes providing data on current health insurance.

Once all documents have been checked, a decision will be issued. No costs are charged for the preparation of the notification.

If the obligation to provide information in accordance with § 97a SGB VIII is not complied with, fines may be threatened or imposed. Fees are charged in this case.

If claims are not settled, dunning procedures and additional fees will be charged.

Benefits are granted exclusively by the General Social Service in cooperation with the Special Services Department of the Youth Welfare Office's Foster Children's Service.

At the WJH, care allowance notices are issued for the carers at the start of assistance.

The amounts are based on the current resolution of the State Youth Welfare Committee to update the lump sums for ongoing maintenance payments for full-time care. This in turn is based on the current recommendations of the German Association for the updating of lump sums for full-time care (§§ 33, 39 SGB VIII).

Payment is made on the 1st of each month.

Certain additional services can be financed within the framework of the City of Chemnitz guidelines on financial benefits for full-time care and family standby care in accordance with SGB VIII. In some cases, applications must be submitted in advance. There are no costs for processing.

You must inform the Youth Welfare Office of any important changes in the personal circumstances of your foster child (e.g. starting an apprenticeship or attending a secondary school). The Youth Welfare Office must also be informed if other social benefits are applied for. Corresponding evidence must be submitted.

Processing of agreements on services, fees and quality developments in accordance with §§ 78a ff SGB VIII

Providers of benefits and services in the above-mentioned forms can apply for agreements on services, fees and quality development in accordance with §§ 78a ff SGB VIII. The application is subject to a specific form andrequires prior counselling by the specialist advisors in the youth welfare planning and special services departments.

Brief description of the procedure:

  1. Specialist counselling is provided by the Youth Welfare Planning Department for Sections 13, 19, 27, 29, 30, 31, 32, 34, 35, 35a, 41, 42 SGB VIII. The Specialised Services department provides advice on §§ 28, 33, 52 SGB VIII.
  2. Double submission of the formal documents in draft form.
  3. Coordination with the specialist counselling service, the provider and the WJH on the documents submitted.
  4. Submission of the final version in paper form (two originals) to the SG WJH without an expiry date.
  5. Formal and technical review.
  6. Once all requirements have been met, either the documents (LV, QEV) are signed or an invitation to negotiate the fee is issued.
  7. Negotiation of fees with the participation of all parties involved.
  8. The fee agreement and all other documents are drawn up and sent to the service provider within 3 to 4 weeks of the negotiation.

Granting of the benefit

The benefit is granted exclusively

  • via the General Social Service and
  • the special services department (foster children service or youth court assistance) of the youth welfare office.
