Location:
The plots are located in the Altchemnitz district and are directly accessible via the public road. There are good transport connections to the city centre, neighbouring districts and the surrounding area. Good public transport connections are guaranteed.
The neighbourhood consists mainly of multi-storey residential buildings.

Utilisation/legal status:
The plots are undeveloped and there are no utilisation relationships.
There are utility installations (gas, communication, drinking water, electricity) of eins energie in sachsen GmbH & Co KG (eins) on the plots that are subject to toleration. A 10kV cable route of eins runs across parcel 121/1, which is secured in rem in the land register.
The line plans can be viewed at the city planning and property office.
There is a groundwater measuring point (GWM) approx. 5 metres deep in the southern area of the plot 116/3. This was set up for the hydrological investigation of the rainwater overflow basin planned at the time. Due to the location of the property on the Chemnitz River, the GWM could possibly continue to be of importance to a potential buyer in the event of a planned development of the property. The maintenance of the facility will continue to be carried out by the ESC or third parties commissioned by it until the sale. If the GWM is of no significance to the purchaser, it will be dismantled by and at the expense of the ESC.
Building law:
The properties are part of the Altchemnitz archaeological area and are located entirely in the designated floodplain of the Chemnitz River and the Zwönitz River.
In designated flood zones, there are considerable restrictions on building in accordance with § 78ff of the Federal Water Act, which therefore lead to very limited usability of the properties. The competent authority can only authorise exceptions to prohibitions in individual cases if this does not conflict with public welfare concerns, flood runoff and flood retention are not significantly impaired, lost retention space is compensated for in terms of scope, time and function and there is no danger to life or health or significant damage to property.
Attention:
In accordance with Section 78 (4) of the Federal Water Act (WHG), the construction and expansion of buildings in floodplains is generally prohibited. By way of derogation from this general prohibition, the construction of structures can only be authorised as an exception if the cumulative conditions specified in Section 78 (5) are met. This means that the project
a) the flood retention is not or only insignificantly impaired and the loss of lost retention space is compensated for extensively, functionally and simultaneously,
b) does not adversely affect the water level and discharge during floods,
c) does not impair the existing flood protection and
d) is designed to be flood-adapted
The effects on the neighbourhood must also be taken into account when examining the requirements.
In addition, in accordance with §78a WHG, the following are prohibited in designated flood zones
- the erection of walls, embankments or similar structures that could obstruct the flow of water,
- depositing and storing objects that could obstruct the flow of water or be washed away for more than a short time,
- raising or deepening the earth's surface
Under building planning law, both parcels are located within the unplanned inner area and are assessed in accordance with Section 34 of the German Building Code (BauGB). They are within the scope of the resolution to draw up development plan no. 1994/035/00 Zöblitzer Straße, which is not currently being processed.
Possible development alternatives should be orientated towards the existing residential development in terms of open or closed construction, building height and building location in relation to the street and logically complement the existing buildings, insofar as permitted by water legislation. A typical suburban maximum two-storey detached house development does not fit in with the development situation.
