What is a petiton?
... requests to a competent authority that contain suggestions on your own behalf, for others or in the general interest.
Petitions can be ...
- Recommendations to do or refrain from doing something specific in the future,
- requests and suggestions that are aimed at action or omission in a personally binding manner, or
- Complaints that are directed against past behaviour and demand its disapproval or correction.
Petitions are not ...
- Expressions of opinion, notifications or instructions without a specific request,
- mere requests for information or requests to inspect files,
- formal legal remedies such as objections or appeals,
- Forms of citizen participation in accordance with §§ 22 - 25 of the Municipal Code for the Free State of Saxony (residents' meeting, residents' petition, referendum, citizens' petition),
- Requests for information from higher authorities on petitions received there.
Procedure of a petition process
The submitter will receive a confirmation of receipt within two weeks of receipt of the petition. The first step is to check which body is responsible for the decision. Petitions that fall under the responsibility of a local council, the state or the federal government are forwarded accordingly.
