As a result of an accident or illness, anyone can find themselves in a situation where they can no longer manage their own legal affairs and need support from others.

In this case, the new care law that has been in force since 1 January 2023 guarantees the greatest possible self-determination, participation, quality and supervision. The person and their wishes are at the centre of all decisions.

If an affected person has not made provisions and the support of family, acquaintances or social services is not sufficient, legal guardianship can be appointed.

The guardianship authority is the point of contact for all questions relating to care and support.

The care authority Chemnitz

The guardianship authority has a variety of tasks. It:

  • informs and advises affected persons, relatives, professional and voluntary carers/care associations and authorised representatives about
    • general and specialised care law issues,
    • powers of attorney and advance care directives,
    • and other support options where no legal representative is appointed,
  • may publicly notarise signatures or hand signs on care orders and powers of attorney of natural persons,
  • co-operates with the guardianship associations,
  • supports the guardianship court.

Public notarisations

Public notarisation is required for certain documents, such as powers of attorney and care directives, to be recognised in legal transactions.

Legal support

If adults are no longer able to manage their own affairs in whole or in part due to illness or disability, the guardianship court will appoint a legal guardian under certain circumstances.
