amending the general order prohibiting the consumption of alcoholic beverages and the carrying of dangerous objects in the public green spaces "Am Wall", "Johannisplatz" and "Park am Roten Turm" of 21 May 2014
The general decree of 21 May 2014 prohibiting the consumption of alcoholic beverages and the carrying of dangerous objects in the public green spaces "Am Wall", "Johannisplatz" and "Park am Roten Turm" is amended in No. 1 is amended as follows:
"It is prohibited to bring glass containers into the facilities designated under No. 3 for the purpose of consuming alcohol."
This amendment comes into force on 19 June 2014.
The general ruling of 21 May 2014 remains otherwise unchanged.
Justification:
The justification can be inspected with the general ruling at the City of Chemnitz, Grünflächenamt, Annaberger Straße 89, 09120 Chemnitz, during general business hours (Section 41 (3) sentence 2 and (4) VwVfG).
Notice of legal remedies
An objection to this general ruling may be lodged within one month of notification. The objection may be lodged with the City of Chemnitz, Markt 1 in 09111 Chemnitz or with any other office or citizen service centre of the City of Chemnitz in writing or for the record.
Publication order:
The above general ruling is hereby published in accordance with Section 41 (3) VwVfG in the currently valid version and is deemed to have been published on 18 June 2014.

General ruling
On the basis of Section 2 (3) sentence 1 of the City of Chemnitz Green Space Statutes in conjunction with Section 35 sentence 2 of the Administrative Procedure Act (VwVfG), as amended, the following is issued
General ruling:
- It is prohibited to bring dangerous objects (e.g. glass bottles), with the exception of glass containers for baby food.
- It is forbidden to consume alcoholic beverages or to remain in the green area under the influence of alcohol from Monday to Saturday between 09:00 and 22:00. The ban does not apply in authorised outdoor catering establishments.
- The general order applies in the public green spaces "Am Wall", "Johannisplatz" and "Park am Roten Turm". The area of application is shown on the attached map. The map is part of the general order.
- The general ruling comes into force on 22 May 2014 and expires at the end of 31 October 2014.
- For reasons of public interest, the immediate enforcement of this general ruling is ordered. This has the consequence that any legal remedy raised has no suspensive effect.

The statement of reasons can be inspected together with the general ruling at the City of Chemnitz, Grünflächenamt, Annaberger Straße 89, 09120 Chemnitz, during general business hours (Section 41 (3) sentence 2 and (4) VwVfG).

Note:
Due to the order of immediate enforcement, an objection to the order has no suspensive effect. Immediate enforcement is necessary here in the public interest, in particular also in the interest of third parties to protect the higher-ranking legal interest of physical integrity over the personal interests of individuals.
