Determination of shorelines along watercourses

The ownership boundaries of an above-ground body of water are determined according to the official property register. However, this only relates to ownership of the watercourse bed; the water itself is not eligible for ownership.

In addition to the general provisions of the Saxon Surveying and Cadastre Act (SächsVermKatG), the regulations in the Saxon Water Act (SächsWG) must also be observed for cadastral surveys and markings on watercourses.

If a cadastral survey of a body of water is applied for, the publicly appointed surveyor (ÖbV) is responsible for determining the boundary[1]. If the ÖbV decides within the boundary determination that the property boundaries are determined by the shorelines, the shoreline as of 26 June 1998 or the date before an earlier artificial change to the shoreline must be determined as a prerequisite for the boundary determination.

The shoreline is determined by the competent water authority at the expense of the applicant for the cadastral survey and demarcation[2].
