Public participation in urban land-use planning
The German Building Code (BauGB) provides for two stages of public participation in the urban land-use planning process (land-use and development plans).
Stage 1: Early public participation (Section 3 (1) BauGB)
The public should be involved in the planning process for urban land-use plans as early as possible. This is usually the case at a point in time when a rough concept for the planning is available, which already presents the general objectives and purposes of the planning in sufficiently concrete terms. However, the planning is still flexible and has not been finalised in every detail.
Participation is organised by publication in the official gazette of the City of Chemnitz followed by a public display (usually for 2 weeks). During this period, the plan will be available for inspection at the City Planning Office in the New Technical City Hall, Friedensplatz 1, in the public display area A 014. The documents will also be made available here.
Comments on the urban land-use plans can be submitted during this period. This is possible in writing, verbally for recording or via the respective e-mail form.
You will have another opportunity to comment on the project during the participation in accordance with Section 3 (2) of the German Building Code (Baugesetzbuch). During the one-month public display period, you can inform us of your comments and concerns if the revised plans have not yet sufficiently taken your suggestions from the first participation phase into account. We would like to point out that only comments submitted on time for the public display in accordance with Section 3 (2) of the German Building Code will subsequently have access to an application in accordance with Section 47 of the German Administrative Court Code.
Stage 2: Public presentation of the planning (Section 3 (2) BauGB)
Once the urban land-use plan has reached a coherent planning stage, it is submitted to the responsible planning, building and environmental committee for a decision on public display. If the plan is approved by the committee, this second stage of public participation can take place.
The public display is announced in the official gazette of the City of Chemnitz at least one week before it begins. The plan is then generally available for inspection for one month at the City Planning Office in the New Technical City Hall, Friedensplatz 1, in the public display area A 014. The documents will be made available here at the same time.
During this time, comments on the urban land-use plans can be submitted. This is possible in writing, verbally for recording or via the e-mail form provided.
